Streszczenie
Celem artykułu jest ukazanie problematyki dochowania terminu do złożenia oświadczenia spadkowego w imieniu małoletniego spadkobiercy w świetle zmian wprowadzonych ustawą z dnia 28 lipca 2023 r. o zmianie ustawy - Kodeks cywilny oraz niektórych innych ustaw[1]. Przewidziano bowiem nowe rozwiązanie - zawieszenie biegu sześciomiesięcznego terminu do złożenia oświadczenia o przyjęciu lub odrzuceniu spadku, jeżeli wymagane jest zezwolenie sądu – na czas trwania postępowania sądowego w tym przedmiocie (art. 1015 § 3 k.c.). Artykuł ten ma zatem ukazać wpływ niniejszej zmiany na sytuację prawną małoletniego spadkobiercy. W artykule podjęto próbę syntetycznego przedstawienia, kto i w jaki sposób może złożyć oświadczenie o przyjęciu lub o odrzuceniu spadku w imieniu małoletniego spadkobiercy.

Making a declaration of acceptance or rejection of inheritance on behalf of the minor heir in the light of the changes introduced by the Act of July 28, 2023 amending the Act - Civil Code and certain other acts
Summary
The aim of the article is to present the issue of keeping the deadline for making an inheritance declaration on behalf of a minor heir in the light of the changes introduced by the Act of July 28, 2023 amending the Civil Code and certain other acts. A new solution has been introduced - suspension of the six-month deadline for submitting a declaration of acceptance or rejection of inheritance, if court permission is required - for the duration of court proceedings in this matter (Article 1015 § 3 of the Civil Code). This article is therefore intended to show the impact of this change on the legal situation of the minor heir. The article attempts to present synthetically who and how can submit a declaration of acceptance or rejection of an inheritance on behalf of a minor heir.
