Streszczenie

 

 

Życie ludzkie jest wartością fundamentalną, warunkującą istnienie człowieka wraz z całym zakresem przysługujących mu wolności i praw. Mają one charakter wtórny wobec życia, bez którego tracą sens. Problemem jest jednak określenie początku życia człowieka, od którego zależy jego prawna ochrona. Ma to ogromne znaczenie w świecie, w którym podważa się istotę prawa naturalnego i relatywizuje wartości. Prowadzi to do niebezpieczeństwa uprzedmiotowienia człowieka, zwłaszcza tego, który znajduje się w najwcześniejszym okresie swego życia, na samym jego początku. Kwestią zasadniczą jest więc próba odpowiedzi na pytanie o początek ludzkiego życia i w konsekwencji określenia momentu, z jakim uzyskuje się status człowieka. W tle wyłania się inne równie ważne pytanie o granice ludzkiego prawodawstwa aspirującego do zastępowania uniwersalnych praw natury.

The right to life and other basic civil rights of the child

Summary

Human life is a fundamental value, conditioning the existence of a human being along with the entire range of freedoms and rights. They are secondary to life, without which they lose their meaning. However, the problem is to determine the beginning of human life, on which its legal protection depends. This is of great importance in a world where the essence of natural law is being undermined and values are being relativized. This leads to the danger of objectifying human beings, especially those who are in the earliest period of their lives, at the very beginning. The issue, therefore, is an attempt to answer the question of the beginning of human life, and, consequently, to determine the moment at which the status of a human being is obtained. In the background, another equally important question emerges about the limits of human legislation aspiring to replace the universal laws of nature.
