Streszczenie

Podjęta tematyka ma na celu analizę najważniejszych elementów stworzonego w państwie polskim porządku prawnego bazującego na aspekcie poszanowania wartości, jaką jest rodzina i dobro dziecka oraz respektowania prawa w ich ochronie. Podstawą podjętych rozważań jest weryfikacja tezy, że obowiązujące przepisy prawa krajowego są spójne z naturalnym porządkiem wynikającym z chrześcijańskiej myśli prawnej. W realizacji podjętego celu analizie poddano zasadnicze przepisy prawa krajowego, jak i wybrane stanowiska wyrażone przez sądy w uzasadnieniach wybranych wyroków względem bezpieczeństwa prawnego rodziny i dziecka.

Selected issues of legal security of the family and a child

Summary

The subject matter is aimed at analyzing the most important elements of the legal order created in the Polish state, based on the aspect of respecting the value of the family and the welfare of the child, and respecting the law in their protection. The basis for the considerations is the verification of the thesis that the applicable provisions of statutory law are consistent with the adopted constitution. In order to achieve the undertaken goal, the fundamental provisions of national law as well as selected positions expressed by the courts in the justifications of selected judgments regarding the legal security of the family and child were analyzed.
