Streszczenie
Artykuł podejmuje zagadnienie mordu sądowego. Problem zostaje zaprezentowany z perspektywy doktrynalnej i penitencjarnej. W pierwszej części pracy przedstawia ideologiczne uwarunkowania mordu sądowego. Ponadto podkreśla znaczenie i funkcję mordu sądowego w Polsce Ludowej. W okresie stalinizmu mord sądowy stał się narzędziem umacniania ustroju komunistycznego oraz instrumentem do eliminacji jego wrogów. W drugiej części pracy autor ukazuje kontekst penitencjarny, który stanowi istotne tło mordu sądowego. W artykule zostają wskazane elementy systemu penitencjarnego ściśle związane ze śledztwem, skazaniem i egzekucją przeciwnika politycznego władz komunistycznych (ofiary mordu sądowego).

Judical murder in People’s Poland in the years 1944-1956 – doctrinal and penitentiary aspects
Summary
The article takes up the issue of judicial murder. The problem is presented from doctrinal and penitentiary perspectives. In the first part of the work the author presents the ideological conditions of the judicial murder. Moreover, the author emphasizes the meaning and function of the judicial murder which it had in the People’s Poland. In the stalinist period in Poland, trial murder became a tool for strengthening the communist system and an instrument for eliminating its enemies. In the second part of the work, the author shows the penitentiary context, which is an important background of the judicial murder. The article points out the elements of the penitentiary system closely related to the investigation, conviction and execution of a political opponent of the communist authorities (a victim of judicial murder).
