Streszczenie
Artykuł w całości poświęcony jest problematyce związanej z zakazem wykonywania przez funkcjonariusza Służby Więziennej zajęcia zarobkowego poza służbą bez zgody jego przełożonego. Pomimo tego, że pragmatyka służbowa odnosi się w treści art. 160 ustawy o Służbie Więziennej do pojęcia „zajęcie zarobkowe” ani w tej ustawie, ani w innych aktach prawnych pojęcie to nie zostało zdefiniowane. Skupiono zatem uwagę na zakresie tego pojęcia oraz na jego definicji. Ponadto szczegółowo opisano procedurę, która umożliwia ubieganie się o zezwolenie na wykonywanie zajęcia zarobkowego przez funkcjonariusza Służby Więziennej.

Prohibition to perform paid occupation by an officer of the Prison Service outside of the service without the permission of the superior
Summary
This paper is entirely devoted to issues related to prohibition to perform paid occupation by an officer of the Prison Service outside of the service without the permission of the superior. Despite the fact that official pragmatics reffers in the text of Art. 160 Act of the Prison Service to the concept „paid occupation” neither in this Act nor in other legal acts this term has been defined. Therefore, attention was focused on the scope of this notion as well as its definition. In addition, the procedure was described in detail which allows the officers of the Prison Service to apply for permission to perform paid occupation outside of the service.
