Streszczenie

W artykule autor przedstawia ocenę regulacji dotyczącej wynagrodze-nia za pracę osób zatrudnionych przebywających w więzieniach. Krytycz-nie oceniony został wyrok Trybunału Konstytucyjnego z 23 lutego 2010 r. (P 20/09), a także jego wykonanie przez ustawodawcę. Autor jest zdania, iż ustawodawca powinien dokonać zróżnicowania wysokości wynagrodze-nia osób pozbawionych wolności w zależności od podstawy zatrudnienia, wskazując, że wynagrodzenie minimalne w pełnej wysokości powinno przysługiwać jedynie zatrudnionym na podstawie umowy o pracę. Od-wołując się do standardów międzynarodowych i orzeczniczych Europej-skiego Trybunału Praw Człowieka (ETPC), autor podaje, że standard konstytucyjny przyjęty przez ustawodawcę w kwestii wynagrodzenia osób pozbawionych wolności jest wyższy niż standard konwencyjny, i nie jest on sprawiedliwy społecznie.

Legal aspects of paid employment of convicts


Summary

In the article, the author presents its assessment of the legislation on wages of people employed in prisons. The Constitutional Tribunal’s judgment of 23 February 2010 (P 9.20) was assesed critically and its implementation by the legislator. The author is of the opinion that the legislator should make a difference in the level of remuneration of persons deprived of liberty taking into account the basis for employment, indicating that the minimum wage in the full amount should refer only to the employment on a contractual basis. Referring to international standards and jurisprudence of the ECHR, the author writes that the constitutional standard adopted by the legislator on the issue of remuneration of prisoners is higher than conventionalstandard and is not socially equitable.
