Streszczenie

Wprowadzenie systemu dozoru elektronicznego zrewolucjonizowało i zdynamizowało proces wykonywania instrumentów reakcji karnej, ale przede wszystkim miało służyć efektywniejszej realizacji celów wyko-nywania tych instrumentów. Tak się jednak nie stało. Artykuł analizuje czynniki normatywne, które w obowiązującym stanie prawnym utrudniają efektywne stosowanie instrumentów reakcji karnej w systemie dozoru elektronicznego. Analizie poddano głównie przepisy regulujące sposób sprawowania dozoru elektronicznego oraz obowiązki kuratorów sądo-wych związane z tym dozorem.

Normative factors hindering the effective usage of instruments of criminal reaction in Electronic Tagging System against the background of recent amendments

Summary

The introduction of an electronic surveillance system has revolutionized and intensified the process of punishment and, above all, was intended to serve more effectively the purpose of punishment. But that did not happen. The article analyzes the normative factors which, in the current legal situation, hinder the effective use of criminal response instruments in the electronic surveillance system. The analysis was mainly concerned with the regulations governing the conduct of electronic surveillance and the probation oficer`s duties associated with this supervision.
